Types of Misdemeanors

Every state penalizes misdemeanors according to their specific guidelines. In the state of Michigan, there are three categories of misdemeanors.

These crime classifications include:

  • Misdemeanors punishable by up to 93 days in jail: These crimes can be sentenced at the state or local level. Some offenses in this category include minor assault and battery, embezzlement regarding less than $200, and disturbing the peace. In addition to 93 days in jail, offenders can be forced to pay fines up to $500.
  • Misdemeanors punishable by up to one year in jail: Crimes in this distinction are handled at the state level. Defendants may also be required to pay fines up to $1,000. Intentional discharge of a firearm without injury, shoplifting, and larceny with a value between $200 and $1,000 all fall into this category.
  • High court misdemeanors: If you are charged with unintentional vehicular homicide or indecent exposure, you may face a high court misdemeanor. They are considered the most serious of misdemeanor cases. Penalties may include up to two years in jail and fines up to $2,000.

Why You Need an Ann Arbor Criminal Defense Attorney

Misdemeanor charges begin with an arraignment and pretrial meeting. Your defense team can use this meeting to talk about your case with the prosecution. We may be able to secure an adjournment, which means that your case will be tabled for the time being, or a plea bargain. In a plea bargain, the client must agree to declare his or herself guilty in exchange for a lesser sentence. In some meetings, we may determine that the best option is to go to trial. This means we will argue your case in a formal courtroom setting in front of a judge and jury.
